Welcome to Defendle!

These Terms of Service (“Terms”) govern your access and use of Defendle (“Game”), a video game developed and operated by Realgames UG (Haftungsbeschränkt) (“we,” “us,” or “our”). By accessing or using the Game, you agree to be bound by these Terms and our Privacy Policy (https://realgames.dev/data/), which is incorporated herein by reference. If you disagree with any part of these Terms, you may not access or use the Game.

1. User Accounts and Registration

1.1 To access certain features of the Game, you may need to create an account (“Account”). You are responsible for maintaining the confidentiality of your Account login credentials and for all activities that occur under your Account. You agree to keep your Account information accurate and up-to-date.

1.2 You may not create an Account with a username that is offensive, hateful, or violates the intellectual property rights of any third party.

1.3 You may not sell, transfer, or share your Account with any other person.

2. Acceptable Use Policy

2.1 You agree to use the Game in a lawful and respectful manner. You will not:

• Transmit or post any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically offensive.

• Impersonate any other person or entity.
• Sell, advertise, or promote any products or services within the Game without our express written consent.
• Interfere with or disrupt the servers or networks used to provide the Game.
• Use the Game in any manner that violates our intellectual property rights or the intellectual property rights of any third party.
• Discriminate against or harass other players based on their race, ethnicity, national origin, religion, gender, sexual orientation, or gender identity.

2.2 We reserve the right to take any action we deem necessary to enforce these Terms, including, but not limited to, terminating your Account, suspending your access to the Game, or taking legal action.

3. Intellectual Property Rights

3.1 The Game and all content therein, including but not limited to artwork, music, sound effects, text, and software, are protected by copyright, trademark, and other intellectual property laws. You own no right, title, or interest in the Game or its content.

3.2 You may not modify, adapt, translate, reverse engineer, decompile, or disassemble the Game or its content.

3.3 You may not use any content from the Game for any commercial purpose without our express written consent.

4. Data Privacy and Security

4.2 You are responsible for maintaining the security of your Account and any data associated with it.

5. Disclaimers and Limitations of Liability

5.1 THE GAME IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

5.2 WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

5.3 WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF YOUR USE OF THE GAME, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

6. Termination of Service

6.1 We may terminate your access to the Game at any time, for any reason, with or without notice.

6.2 You may terminate your Account at any time.

7. Governing Law and Dispute Resolution

7.1 These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

7.2 Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Germany.

8. Entire Agreement

8.1 These Terms constitute the entire agreement between you and us regarding your use of the Game.

9. Severability

9.1 If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

10. Waiver

10.1 Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision.

11. Content Creators

11.1 We grant permission to content creators (such as YouTubers, streamers, etc.) to use, display, and create derivative works of game content, strictly for the purpose of creating and sharing their gameplay videos, reviews, walkthroughs, and other similar content. This permission is non-exclusive, worldwide, and royalty-free.

11.2 This permission does not extend to other game developers, publishers, or any other parties intending to use our game content for creating or promoting their own games or for any other commercial purposes not expressly permitted in these Terms.
